Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following expressions mean:

  • Withdrawal period: the period during which the consumer can exercise their right of withdrawal.

  • Consumer: any natural person who is not acting in the course of a commercial or professional activity and enters into a distance contract with a trader.

  • Day: a calendar day.

  • Contract for ongoing supply: a distance contract covering a series of products and/or services where the delivery and/or purchase obligations extend over time.

  • Durable medium: any tool that enables the consumer or trader to store information addressed personally to them so that it can be accessed in the future and reproduced without changes.

  • Right of withdrawal: the consumer’s ability to cancel the distance contract within the withdrawal period.

  • Trader: the natural or legal person who offers products and/or services to consumers via distance selling.

  • Distance contract: an agreement concluded within a system organized by the trader for distance selling of products and/or services, exclusively using one or more means of remote communication up to the conclusion of the agreement.

  • Means of remote communication: any means that can be used to conclude an agreement without the consumer and trader being simultaneously present in the same location.

  • Terms and conditions: the current terms and conditions of sale of the trader.

Article 3 – Applicability

These terms and conditions apply to every offer from the trader, as well as to every distance contract and any order placed between the trader and the consumer.

Before concluding a distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed prior to the conclusion of the contract where these terms can be consulted and that they will be sent free of charge upon request as soon as possible.

If the distance contract is concluded electronically, a copy of these terms and conditions will be made available electronically so that the consumer can easily store them on a durable medium. If this is not reasonably possible, the trader will inform before the contract is concluded where the terms and conditions can be consulted electronically and that they will be sent free of charge upon request.

In case of conflict between these terms and any special conditions applying to certain products or services, the conditions most favorable to the consumer will prevail.

If any provision of these terms and conditions is declared invalid or annulled, the remainder of the agreement and terms will remain in force. The invalid provision will be replaced by a provision that best reflects the original intent.


Article 4 – Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly indicated in the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly assess the offer. If images are used by the trader, they accurately reflect the products and/or services offered. Obvious errors or inaccuracies in the offer do not bind the trader.

Each offer includes information such as the rights and obligations connected to it if the consumer accepts the offer.


Article 5 – Agreement

The agreement is concluded, subject to the provisions of Article 6, when the consumer accepts the offer and fulfills the related conditions.

If the agreement is concluded electronically, the trader will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment.

The trader may, within the limits of the law, investigate the consumer’s ability to fulfill payment obligations as well as any relevant circumstances necessary to conclude the distance contract.


Article 6 – Right of withdrawal

For product purchases, the consumer has the option to cancel the agreement without giving reasons within 30 days. This withdrawal period starts the day the consumer or a pre-designated representative receives the product.

During the withdrawal period, the consumer must treat the product and its packaging with care. The product may only be opened or used to the extent necessary to assess whether they wish to keep it. If the consumer exercises their right of withdrawal, they must return the product with all accessories and, insofar as possible, in its original condition and packaging according to reasonable and clear instructions given by the trader.

When the consumer wishes to exercise their right of withdrawal, they must inform the trader within 30 days after receiving the product. This information must be given in writing, e.g., via email. After notifying the trader, the product must be returned within 30 days. The consumer must provide proof that the returned goods were sent on time. This can also be done by sending directly to our supplier in China. For example, the consumer can provide shipping proof.

If the consumer does not notify the trader within the stated deadlines or does not return the product, the sale is considered final.


Article 7 – Costs of withdrawal

If the consumer exercises the right of withdrawal, the costs of returning the products are entirely borne by the consumer. This includes return shipping to the origin country, i.e., our supplier in China.

If the consumer has paid an amount, the trader will refund this amount as soon as possible, and no later than 30 days after withdrawal. This only applies if the product has already been received by the trader or if full proof of return has been provided.


Article 8 – Exclusion of the right of withdrawal

The trader may exclude the right of withdrawal for certain products or services, but only if this is clearly stated in the offer and before the conclusion of the contract.

The exclusion applies only to products:
a. that may deteriorate or expire quickly;
b. that are sealed for health or hygiene reasons and have been opened after delivery;
c. that have been irreversibly mixed with other goods after delivery.


Article 9 – Prices

Prices for products and/or services stated in the offer are not subject to increases during the period stated in the offer, except in the case of changes in VAT rates.

The trader may offer products or services with prices subject to fluctuations on financial markets beyond their control, with variable prices. This dependence on fluctuations will be indicated in the offer.


Article 10 – Conformity and warranty

The trader guarantees that the products and/or services correspond to the agreement, the specifications mentioned in the offer, the reasonable requirements of reliability and/or usability, and the applicable legal provisions at the time the contract is concluded.


Article 11 – Delivery and execution

The trader will exercise due care in receiving and executing product orders and assessing services.

The delivery location is the address provided by the consumer to the trader.

Subject to Article 4, the trader will execute accepted orders as quickly as possible and at the latest within 30 days, unless otherwise agreed. If delivery is delayed or an order cannot be fulfilled fully or partially, the consumer will be informed no later than 30 days after ordering. In such cases, the consumer may cancel the agreement free of charge.

After cancellation as described above, the trader will immediately refund any amounts paid.

Risk of damage and/or loss of products lies with the trader until delivery to the consumer or a designated representative, unless otherwise agreed.


Article 12 – Payment

Unless otherwise agreed in the contract or additional terms, payments owed by the consumer must be made within 14 days after the start of the withdrawal period or, if no withdrawal period applies, within 14 days after the conclusion of the contract.

The consumer is obliged to immediately notify the trader of any errors in the payment details provided.

If the consumer fails to fulfill payment within the deadline after being informed of the delay and given an additional 14 days to comply, the consumer will owe statutory interest on the outstanding amount, and the trader may charge extrajudicial collection costs. These costs amount to a maximum of: 15% of outstanding amounts up to €2,500, 10% of the next €2,500, and 5% of the following €5,000, with a minimum of €40. The trader may deviate from these amounts in favor of the consumer.


Article 13 – Complaint procedure

The trader has a complaint procedure that is adequately communicated to the consumer and processes complaints in accordance with this procedure.

Complaints regarding contract performance must be submitted to the trader within a reasonable time, fully and clearly describing the defects after the consumer has discovered them.

Complaints submitted to the trader will be answered within 14 days of receipt. If longer processing is needed, the trader will acknowledge receipt within 14 days and indicate when a detailed response can be expected.


Article 14 – Disputes

Agreements between the trader and consumer under these terms are exclusively subject to Chinese law.

Any dispute will be brought before the competent court in the trader’s place of residence or registered office unless mandatory laws dictate otherwise.


Article 15 – Additional provisions or exceptions

Additional provisions or exceptions to these terms must not be detrimental to the consumer and must be made in writing or in a way accessible to the consumer on a durable medium.


Notes on adaptations for Melbourne/Australia:

  • Currency references (Article 12 and 7):
    Euros (€) could be replaced by Australian dollars (AUD), and corresponding percentage thresholds might be adjusted to local legal standards.

  • Consumer rights and withdrawal (Articles 6 and 8):
    Australian consumer law provides different and often more extensive rights than EU distance selling laws. For example, there is generally no “cooling-off” period for online purchases unless explicitly offered by the seller. Adjust withdrawal terms accordingly if needed.
